
It is unfortunate that the sports industry in Kenya has, lately, been subjected to ridicule and degenerating actions thanks to corrupt merchants of impunity from within the Football Kenya Federation.
FIFA rules are crystal clear on the use of mainstream (ordinary) courts to resolve disputes and otherwise prefer and support a sports arbitration process. A position shared by many other sports federations across the country.
This led to the birth of Sports Dispute Tribunal under the Sports Act 2013.
It is unfortunate that the current FKF office has resorted to “anonymously” filing cases in three regional courts to block the much-celebrated Sports Dispute Tribunal from discussing and or handling any football matters.
The relatively new SDT has been a trusted breath of fresh air to all sports stakeholders. It has been an avenue for justice in sports disputes and a key pillar for hope in the entire industry.
To frustrate aspirants by dodging free and fair elections through numerous litigation outside the SDT is a gross violation of court process and must be condemned by all Kenyans.
To publicly disparage the SDT and its Chair, John Ohaga is not only petty but malicious in intent and sets a dangerous precedent.
Perpetuating ridicule, arrogance, impunity and contempt towards the Ministry of Sports, Registrar of sports and the Sports Act under the guise of FIFA’s policy of non-interference is treachery beyond measure.
Our laws of the land are supreme to any foreign or local association rules and regulations and must therefore be followed without exception.
The delaying tactics by FKF is designed to create an escape from accountability, mismanagement of public resources and orchestrating an illegal electoral process. Something we shall never allow.
I am hereby calling upon the CS for Sports, Arts and Culture, Madam Amina Mohammed, to exercise her powers and implement the sports act with immediate effect and constitute a normalization committee to clean up the mess that is FKF.
