
The Court of Appeal has rejected former Nairobi Governor Evans Kidero’s bid to halt a civil lawsuit against him.
The Ethics and Anti-Corruption Commission (EACC) is actively pursuing the recovery of Sh58 million, which is believed to have been misappropriated from Nairobi County during Kidero’s tenure.
“The ruling creates a good precedent given the many petitions and Judicial Review Applications that EACC faces in the event of concurrent civil and criminal cases against the same parties,” EACC said.
It added that the decision will subsequently reduce the amount of time required to resolve anti-graft cases.
The anti-corruption court had previously dismissed the Kidero case in 2021, citing a lack of clarity in the charge.
Chief Magistrate, Douglas Ogoti, ruled that the charge sheet presented in court failed to show what crime Kidero had committed.
