Sospeter Ojaamong: Court to rule whether Busia Governor will face KSh8m graft case

Busia Governor Sospeter Ojaamong will, on 29 May, know whether he has a case to answer or not as he faces corruption charges.



This is after the parties in the case made their submissions on Monday before the Nairobi Anti-corruption Magistrate Douglas Ogoti.



The office of the DPP on its part has urged the court to find that the governor together with other accused persons have a case to answer arguing that the evidence adduced by the prosecution establishes a prima facie case to warrant the accused persons to be charged.



Ojaamong and nine others are charged with engaging in a scheme to defraud the Busia County government of KSh8million between the months of March and September 2014.



They are facing seven counts ranging from abuse of office, conspiracy to commit economic crimes and engaging in a project without proper planning.



According to the prosecution there was no evidence of any monies being received by the county government of Busia in form of grants.



Similarly, the court was told that Ojammong being the chairman of the Busia County Budget and Economic Forum ought to have known that the item was not in the budget or planned for.



The prosecution further argued that the process used to procure the feasibility study on solid waste management was flawed and in contravention of the provisions of the PPDA 2005.
